These General Terms and Conditions govern the terms and conditions of use, as well as the conditions for online trading through the website pool-expert.eu, briefly referred to as the "Website", owned by BG Handel Ltd. Any natural or legal person visiting or using the website to place orders for the purchase of goods, hereinafter is called "User" for short.

• Subject:

The Website provides the User with product information and the opportunity to purchase the goods offered in the online store after registration by making an order and paying the relevant selling price, with strict observance by the consumer of these General Terms and Conditions, of all common commercial practices in the country, as well as the additional relevant requirements for the specific goods. The online store provides general information about the products, which contains a description of the main characteristics and an image of each product, the selling price, VAT included, information about the methods of payment, delivery and performance of the contract.

The goods published for sale on the Website are ORIGINAL, of proven origin and are resold to BG Handel Ltd. by the manufacturers. The Website is not responsible for any incorrect information provided by the manufacturer on the characteristics of the goods. Trademark rights are the property of the respective manufacturer.

• Registration:

The user can only make online purchases after registration. When filling in the registration form, the user is obliged to provide complete and correct information about his/her identity and other data required by the myspa.bg form, as well as to update them with each subsequent purchase. The User warrants that the information provided by him during the registration process is correct and complete.

In the event of a dispute as to which person has committed to these General Terms and Conditions, the person who has paid the price of the requested goods requested is considered to be a party to the contract of sale.

• Purchase:

The user has the opportunity to buy the goods offered by the Website after he has registered and logged in to his account. The ordering of a particular product is done by pressing the ‘’BUY’’ button, which is present in the offer of the desired product. This action is a volition that binds the user and the seller explicitly with the power of the contract.

If the User provides an incomplete or incorrect address or telephone number when submitting the order, the order is considered to be invalid and no obligation for its execution by the Website arises.

• Prices:

All prices on the Website are in Bulgarian leva, VAT included, corresponding to one piece.

When choosing to pay on delivery (cash on delivery), the User pays the due amount to the courier.

• Delivery and Methods of delivery:

Delivery of accessories and water treatment products is paid.

1)      Delivery time is within 1 business day for available products.

2)      When choosing "cash on delivery", the customer is obliged to pay the goods to the courier upon receipt.

The products are delivered packaged according to their type and method of delivery. The seller makes every effort to ship the goods as quickly as possible.

The Seller has the right to deliver the product to the delivery address to the User or to a third party, who accepts and confirms its receipt on behalf of the Client and signs the supporting documents.

If the User does not provide the conditions for the delivery of the goods or is not found at the address indicated by him within the aforementioned period, the seller is released from his obligation to deliver the requested goods.

• Claims and Returns:

The User has the right to refuse the goods requested by him if:

1)      The product clearly does not correspond to the User’s request for purchase and this can be ascertained by an ordinary inspection;

2)      The goods or their package were damaged during transportation. In this case, the User should contact the courier, who is obliged to establish a protocol for damage during shipment.

3)      The price does not correspond to the due price.

All claims are accepted within 5 working days of receipt of the goods. The User is obliged to inform pool-expert.eu before submitting a claim.

• Cancellation of order:

The User has the right to refuse (cancel) the submitted order request within 1 working day from the date of its submission, by notifying his action to the operator at myspa.bg at the following e-mail address office@pool-expert.eu .

The User has the right to withdraw from the concluded contract within 14 working days from the date of receipt of the product, without owing compensation or penalty.

If the consumer withdraws from the contract within the specified time limit, he must notify the seller and return the product in its original packaging, with the original labels, without any indication that the product has been used, damaged or treated in any way, by virtue of section 55 of the Consumer protection law. The costs of returning the goods is at the expense of the buyer!

After receiving and inspecting the returned goods, the seller reimburses the consumer for the amount paid by him /without the return shipping costs to pool-expert.eu/ within 30 days from the date on which the consumer exercised his right of withdrawal from the contract.

After receiving and paying for the product, the client may make a claim, or request a return and refund for the amount paid by him, in the following cases and terms:

-          if during its operation there are any damages, foreseen as warranty;

-          in the cases provided for in Article 69, para. 3 of the Consumer Protection and Trade Law.

• Rights and obligations of the parties:

The seller is obliged to deliver the requested product in its intact in time and to transfer the ownership of the goods. The goods published for sale on the Website are ORIGINAL, of proven origin and are resold to BG Handel Ltd. by the manufacturers. The Website is not responsible for the incorrectness of the information provided by the manufacturer on the characteristics of the goods. Trademarks and brands are used to better describe the goods on the Website. Trademark rights are the property of the manufacturer.

The User is obliged to make every effort, in order to protect his password, not to give his Username and password to anyone, and in case of unauthorized access to his account or in the likelihood of such access, to immediately notify the Website.

For the sake of security of username and password, always press the "Log out" button when leaving the online store. Also, the User should not submit fictitious or invalid requests, but must always indicate the exact delivery address, e-mail address and telephone number and, when a valid order is made, pay the price of the requested goods.

The User is also obliged not to interfere with the proper functioning of the online system of the store, to take no action that leads to blocking and denial of the services on the Website, and also not to obstruct the identification of other Users of the store or their right to use the store.

If the User of the online store does not comply with the above obligations, the Website has the right, without prior warning, to terminate his access to the profile, as well as to claim for lost benefits and harm as a result of the User's misconduct.

• Copyrights:

All texts, images, photos and articles published on this site are copyrighted and are protected by the Copyright and Related Rights Law and the subsidiary Bulgarian and foreign legislation. Their use, without the explicit consent of the author, is contrary to the Bulgarian legislation.

• Changes to the Terms and Conditions:

These Terms and Conditions may be modified unilaterally by the Website. The revised Terms and Conditions will be accessible through a prominent link on the site.

Changes to the Terms and Conditions do not affect the relationship between the User and the Website arising from a valid purchase request for goods made prior to the changes in the Terms and Conditions.

These general terms of use comply with the Bulgarian Commercial Law, the Consumer Protection Law, the General Data Protection Regulation. For issues not settled by these General Terms and Conditions, the applicable legislation of the Republic of Bulgaria shall apply.

• OTHER TERMS:

BG Handel Ltd. is not responsible:

1. In relation to the client, in case of lack of stock availability of the offered goods or other impossibility of delivering the offered goods to the client immediately, or within the agreed term.
